Woman Seriously Injured in Pedestrian Accident to Receive $650k Settlement from the City of Long Beach

|

On Dec 3rd, 2009, a 21-year old Cal State Long Beach student was out for an early evening jog when she was struck at Clark Avenue and Los Coyotes Diagonal in Long Beach [CA], by a Subaru Forester going southbound on Clark, at 35 to 40 mph. The young woman sustained serious injuries in the accident, including a significant skull fracture which required that part of her cranium be removed. According to her attorneys, the victim continues to suffer from permanent physical, cognitive and neurological impairments.

The victim alleged that the cause of the accident was due to the poor timing of the traffic lights at the intersection where she was hit and seriously injured, and in turn filed a suit against the City of Long Beach. Deputy City Attorney, Monte Machit, stated that the interval between when one traffic light turns green after the opposing traffic light turns red was 1.8 seconds. While that timing falls within the standard of 0.1 second to 2 seconds at a standard intersection, the particular intersection where the accident took place is a three-way, diagonal intersection.

On July 24th, 2012, the Long Beach City Council approved the recommendation, with an almost unanimous vote, to pay the victim a $650k settlement.
