3-Car-Crash in Winnetka Injures 4

|

Three cars collided in a San Fernando Valley intersection on Tuesday afternoon, leaving four people injured.

The accident happened about 1:50 p.m. at the intersection of Roscoe Blvd. and Winnetka Ave., where Winnetka Elementary School is located. The driver of a silver Nissan Xterra SUV may have run a red light. The Xterra crashed into a red Ford Focus. The Ford Focus then careened into a minivan, and then the Focus struck a 40-year-old mother and her 6-year-old daughter who were standing at the corner waiting to cross the street.

According to witnesses who observed the crash, the mother and her daughter were pinned between the two vehicles.

The mother and child were transported to a local hospital. According to the Los Angeles Fire Department, the child was in critical condition. Her mother was in serious condition.

The two occupants of the Ford Focus, a 61-year-old male and 26-year-old female, both were reported to be in fair condition. Photos taken at the scene show major front and side damage to the Focus, and deployed airbags.

Critical Issue: How Much Insurance Does the At-Fault Driver have?

When a multi-car accident results in injuries to multiple victims, and only one driver is at fault for the accident, the issue is: how much insurance does the negligent driver have? Will that driver have sufficient policy limits to cover everyone’s injury claims?

Though California law requires that all drivers carry liability insurance, many drivers don’t. Even if they show proof of insurance to the police officer, it may later turn out that their policy had lapsed for nonpayment. This is an all too common scenario we encounter at our personal injury law firm.

That is why one of the first questions we ask our clients who were injured by a car, whether our client was driving, walking or biking at the time they were hit, is: Do you have uninsured motorist coverage, and how much? If you have uninsured motorist coverage, then your insurance company may pay for your injury claim if it turns out that the at-fault driver had no insurance, or not enough insurance.
