OCTA Bus and Vehicle Crash; 1 Injured

A vehicle and OCTA bus crashed Saturday evening, leaving one injured.

According to the Orange County Sheriff’s Department, the accident between a vehicle and an Orange County Transportation Authority bus happened about 7 p.m. at the intersection of Pacific Coast Highway and Niguel Rd. in Dana Point. The vehicle’s driver was injured in the collision and transported to a local hospital.

The cause of the accident is still under investigation. The name of the driver of the vehicle has not been released.

Claims Involving a City Bus

If the bus driver was at fault for the accident, the driver of the vehicle must file a Claim for Damages with the OCTA within six months of the accident, or the driver’s claim is barred by operation of law. The OCTA will in all likelihood deny the claim, even if it was clearly the bus driver’s fault. A governmental entity’s denial of a claim is routine. But that doesn’t mean that the governmental entity won’t pay the claim. Even after the governmental entity denies the claim, if the accident was clearly the fault of the bus driver, the governmental entity will likely offer to settle the claim if the driver of the car suffered injuries.
