Case Background
In March 2014, Mr. Springer, 55, was struck by a Toyota Venza as he rode his Honda Shadow motorcycle. Randall Russell was driving the Toyota at the time for his employer, Sysmex America, Inc. During an unsafe lane change, his car collided with Mr. Springer's motorcycle, bringing Mr. Springer to the pavement.
Mr. Springer sustained the following injuries:
- Broken clavicle
- Broken ribs
- Torn rotator cuff (requiring surgery)
Despite the circumstances of the accident, Sysmex America, Inc. and their insurance provider, Pacific Specialty Insurance Co. refused to provide proper relief to Mr. Springer. Mr. Springer was claiming $250,000 in total damages. The best offer provided by Pacific Specialty Insurance Co. was $160,000.
The Trial
Attorney McGee and Attorney Kenneth Dean Ogrin represented Mr. Springer for the four-day trial. Pacific Specialty Insurance Co. and Sysmex America, Inc. continued to refuse responsibility for the accident: they claimed that Mr. Springer had rear-ended Rusell's vehicle and that Mr. Springer's depression medication left him with questionable control over his motorcycle.
Attorney McGee, however, presented a compelling case that clearly depicted Mr. Russell's dangerous lane change and the significant expenses and burdens that Mr. Springer was left with because of that action. Ultimately, the jury agreed with Attorneys McGee and Ogrin and awarded Mr. Springer $543,789—a sum more than three times larger than Pacific Specialty Insurance Company's best offer.
