HIT A STALLED CAR ON THE FREEWAY. WHO'S AT FAULT?

Over the years, we have handled many car accidents involving our client hitting a stalled car on the freeway. Who is at fault for such an accident? Many factors play a part in assessing whether the owner/driver of the stalled car on the freeway is fault for the accident.

  • Did the owner/driver of the stalled car fail to keep his/her car in good repair? If yes, then the owner/driver of that car should have anticipated that the vehicle could stall out, which would place liability on that owner or driver.
  • Were the stalled car's hazard lights on? Failing to put them on would place negligence on the driver of that vehicle.
  • Were you speeding when you hit the stalled car? If yes, that could place some or all of the liability on you if you could have avoided the stalled hitting the car had you been traveling within the speed limit.
  • Were you inattentive? If an attentive driver could have seen the stalled car ahead and avoided it, that could absolve the owner/driver of the stalled car of some or possibly all liability.
