|

Two vehicles collided in a Fullerton intersection on Friday, injuring three people.

The accident happened just after 7:50 a.m. on North State College Blvd., near Rolling Hills Dr.

One of the vehicles overturned, leaving a woman trapped inside. Firefighters extricated the woman, after which she was transported to Western Medical Center in Santa Ana. Two men were also injured in the accident, and transported to UCI Medical Center in Orange.

The cause of the crash is still under investigation.

Intersection Collision – Who’s At Fault

If the two vehicles involved in the accident were traveling on perpendicular streets and collided in the intersection, the at-fault driver is the one who violated the other driver’s right of way.

The intersection of North State College Blvd. and Rolling Hills Dr. is controlled by a traffic signal. It is not unusual in intersection collisions for each driver to blame the other for running a red light. When the police write a traffic collision report, they interview each driver, sometimes the passengers, and any witnesses to the accident.

If there are no witnesses and each driver claims the other ran the red, then it can be a difficult case. If it's a he said - she said, and there is no evidence to break the tie, then each insurance company will likely deny the other party’s claim.

After such an accident, it is critical to canvass the area for possible witnesses and possible video surveillance cameras that may have captured the accident.

If you have been injured in an intersection collision, you should seek the guidance of a personal injury lawyer as soon as possible after the accident. Even if you decide not to pursue a claim, or if the attorney tells you he or she can’t take your case, we strongly recommend that you speak to a lawyer before you speak to the other driver’s insurance company. Personal injury lawyers provide free consultations, so you have nothing to lose and everything to gain.
